Terms of Service

These Terms of Service govern use of the Aimlora Target website and the purchase or receipt of remote targeted advertising, audience research, paid-social campaign setup, campaign review, optimization and related project services. A written proposal, invoice or project confirmation may contain additional terms. If a signed project document directly conflicts with these website terms, the signed document controls for that project.

Eligibility and Authority

A person requesting services must be at least 18 years old and legally able to enter a binding agreement. A person acting for a business confirms that the person is authorized to provide instructions, approve materials, grant account access and accept these terms for that business.

Project Formation

Submitting a website form does not automatically create a service agreement. A project begins only after scope, price, required materials, timing and payment terms are confirmed in writing and any required initial payment has been received. Website prices are starting prices and may change according to platform count, campaign count, account condition, research depth, urgency and requested deliverables.

Services

Services may include audience research, targeting recommendations, advertising campaign configuration, campaign audit, retargeting setup, limited optimization work, monthly management and written reporting. The precise deliverables are those listed in the accepted project scope. Work not included in the accepted scope requires a separate written agreement or change approval.

Client Responsibilities

The client must provide complete and accurate business information, lawful offers, approved claims, current website pages, creative materials, required notices, platform access and timely approvals. The client remains responsible for the truthfulness and legality of its products, services, prices, claims, testimonials, promotions, privacy practices and fulfillment.

The client must review campaign settings, copy, audiences, budgets and destination links before final approval or launch. A delay in access, content or approval may move the delivery schedule. Aimlora Target is not responsible for delay caused by missing client inputs, platform review, account restriction, technical outage or third-party action.

Advertising Accounts and Platform Rules

The client retains ownership and control of its advertising accounts. Access should be granted through platform-supported roles rather than shared passwords. The client must maintain account security, valid payment information and compliance with platform policies. A platform may reject, limit, suspend or remove an advertisement or account at its discretion. Aimlora Target cannot guarantee approval, delivery volume, account availability or continued access to any platform feature.

Advertising Spend and Third-Party Charges

Service fees do not include advertising spend, platform charges, taxes, stock assets, software subscriptions, website development, original photography, video production or third-party professional services unless expressly stated. Advertising spend is paid by the client directly to the platform. The client controls the approved budget and remains responsible for platform billing.

Approvals and Revisions

The client must review delivered work within the period stated in the project scope. Included revisions address reasonable changes within the original scope and do not include a new strategy, different offer, additional platform or material change in direction. Silence, publication, launch or continued use may be treated as acceptance where permitted by the project terms.

Payment

Invoices are payable according to the stated due date. Work may be scheduled only after a required deposit or full payment is received. Overdue amounts may result in paused work, delayed delivery or suspension of access-related activity. Additional billing terms appear in the Payment & Billing Policy.

Results and Business Decisions

Advertising involves uncertainty. Results depend on budget, market conditions, competition, offer, pricing, creative quality, website experience, tracking, seasonality, platform changes and client fulfillment. Aimlora Target does not guarantee impressions, leads, sales, revenue, profitability, return on advertising spend, account approval or a specific performance result. The client makes final business, budget and publication decisions.

Intellectual Property and Confidentiality

The client retains rights in materials it supplies. Rights in final paid deliverables are governed by the accepted scope and the Intellectual Property & Confidentiality Policy. Pre-existing methods, general know-how, templates, processes and tools remain the property of their original owner. Third-party materials remain subject to third-party license terms.

Acceptable Website Use

A visitor may not interfere with website operation, attempt unauthorized access, submit malicious code, scrape protected content, impersonate another person, misuse forms, or use the website for unlawful activity. We may restrict access when reasonably necessary to protect the website, clients, providers or business operations.

Disclaimer and Limitation

The website is provided on an available basis. To the maximum extent permitted by law, services and website information are provided without warranties not expressly stated in an accepted written agreement. Aimlora Target is not responsible for indirect, incidental, special, punitive or consequential loss, lost profit, lost opportunity, lost data or third-party platform action. Any aggregate liability arising from a specific paid project will not exceed the service fees actually paid for that project during the three months preceding the event giving rise to the claim, except where applicable law does not allow that limitation.

Indemnification

The client agrees to defend and hold Aimlora Target harmless from third-party claims arising from client-provided materials, unlawful products or claims, missing disclosures, infringement, account misuse, violation of platform rules, or instructions that conflict with law or third-party rights, except to the extent caused by Aimlora Target's proven willful misconduct.

Suspension and Termination

Work may be paused or terminated for nonpayment, abusive conduct, unlawful instructions, material breach, security concerns, repeated failure to provide required information, or a platform restriction that prevents performance. Amounts owed for completed work and committed non-cancellable costs remain payable.

Governing Law and Disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Before filing a formal claim, the parties should make a reasonable good-faith effort to resolve the issue through written communication. Courts with lawful jurisdiction in Kentucky will have venue unless a mandatory law requires otherwise.

Changes and Severability

These terms may be updated for future website use and future projects. If one provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision once is not a permanent waiver.
